Restaurant Order Form
DineStack is a restaurant technology product provided by LEAP RIDE, INC., a New York corporation.
Agreement governing this order: DineStack Restaurant Master Subscription Agreement (MSA) and applicable Data Processing Addendum.
Provider: LEAP RIDE, INC., 967 Little Britain Rd, Suite 300, New Windsor, NY 12553, United States. Contact: info@dinestack.app.
A. Customer information
At online signup the customer information is what the signing owner enters: the owner's full name, email address and a US or Canadian telephone number, the restaurant's name and the number of locations the restaurant plans. The restaurant's address, country and business details are completed during onboarding in the restaurant's account. The person signing up confirms that they are authorized to bind the restaurant.
B. Subscription details
Marketing intake submitted (if any): informational only; not itself a contract.
Product: DineStack restaurant operations software (features actually released/enabled).
Plan: Standard monthly, no minimum annual commitment.
Billed locations (quantity): 1 at signup. The number of locations planned at signup is for onboarding only and does not change this charge. Each further location is billed at USD $149 per month only after an authorized owner adds it.
Monthly base price per billed location: USD $149.
Monthly pre-tax recurring total: USD $149.00 for one billed location.
Applicable sales/use tax: any tax that applies is shown at Stripe Checkout and on the invoice before it is charged.
Initial subscription start/billing date: the day the first payment is completed at Stripe Checkout; the subscription then renews on the same day each month.
Billing recurrence: monthly, automatically renews until canceled.
Payment method: a card entered on Stripe's hosted checkout page, billed through Stripe Billing on DineStack's own account. This is separate from any card processing a restaurant uses for its own sales.
Activation: The restaurant's account opens only after Stripe confirms the first payment to DineStack. Until then the owner can sign in, see the subscription status, complete or resume checkout and ask for account help; menus, staff, devices, registers, the kitchen screens, financial records and setup stay closed. There is no trial period and no unpaid operating access.
Unpaid registrations: A checkout that is canceled, fails or is left unfinished charges nothing and opens nothing; the owner can return and complete it. A registration still unpaid after 30 days expires. DineStack keeps its records of the registration, and the owner can ask info@dinestack.app to reopen it.
Hardware / third-party items: none are included; any hardware or third-party service is ordered and paid for separately.
C. Material commercial disclosures
1. Restaurant is the food seller and remains responsible for food-service operations, employees, taxes, guest refunds and payment disputes.
2. Subscription pricing is separate from third-party payment-processing and marketplace fees; eligible processing requires an additional Stripe connected-account agreement.
3. No cancellation penalty applies to this standard month-to-month plan. Cancellation ordinarily takes effect at the end of the paid monthly period and normally does not prorate the already-started period, subject to applicable law and written agreements.
4. Material future increases in standard monthly recurring price receive at least 30 days' advance notice.
5. Features such as live card acceptance, marketplace order tools, payout features, Canadian Interac, Tap to Pay and particular hardware integrations are available only after separate certification and activation; marketplace source naming does not represent a delivery platform partnership.
6. Provider licenses software access but does not sell its intellectual property or source code.
D. Agreement acceptance
At online signup the owner accepts this order with two separate boxes, neither ticked in advance: one accepts the identified versions of this Order Form, the Restaurant Master Subscription Agreement, the Refund and Cancellation Policy, the Data Processing Addendum, the Acceptable Use Policy and the Pricing and Payment Disclosures; the other authorizes the monthly recurring charge. A third box, for product news by email, is optional and is never required.
Customer authorizes monthly recurring charges shown above until valid cancellation under the Agreement.
DineStack keeps a record of each acceptance: the restaurant and the person who accepted, how they signed in, the document versions and a fingerprint of each text, the exact wording of both statements, the recurring charge authorized (amount, currency, frequency and number of locations) and the time, with limited device and network information. The record never contains a password or card details.
